1. About these terms
These terms govern your use of ClearMTD, a Making Tax Digital compliance service operated by SH Applications Limited (trading as ClearMTD). By creating an account, you agree to these terms.

2. What ClearMTD provides
ClearMTD is a software tool that helps UK sole traders and landlords:
- Record income and expenses
- Submit quarterly updates to HMRC under Making Tax Digital for Income Tax Self Assessment (MTD ITSA)
- View their submission history and obligation deadlines
3. Your responsibilities
When using ClearMTD, you agree to:
- Provide accurate information. You are responsible for the accuracy of all data you enter, including your NINO, UTR, and financial records. ClearMTD submits what you provide — we do not verify your figures.
- Keep your account secure. You are responsible for keeping your login credentials confidential. If you suspect unauthorised access, contact us immediately.
- Comply with tax law. ClearMTD is a tool to help you meet your MTD obligations. It is not a substitute for professional tax advice. You remain legally responsible for your tax returns and submissions to HMRC.
- Use the service lawfully. You must not use ClearMTD for any fraudulent, illegal, or unauthorised purpose.
4. Tax submissions
When you submit a quarterly update through ClearMTD, we send your data to HMRC via their official API. Once submitted, this data is on your HMRC record. You should review your figures carefully before submitting.
ClearMTD is not an accountant, tax adviser, or HMRC agent. We provide the software platform only. If you are unsure about your tax position, seek professional advice.
5. Account and eligibility
- You must be at least 16 years old to use ClearMTD
- You must be a UK taxpayer with a valid NINO and UTR
- One account per person — do not share your account with others
6. Pricing and payment
ClearMTD offers a free trial period. Paid subscriptions are billed through Stripe. Prices are displayed in GBP and inclusive of VAT where applicable.
We may change our pricing with reasonable notice. Any price changes will not affect your current billing period.
7. Cancellation and refunds
You can cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period — you will not be charged again.
We do not offer refunds for partial billing periods. If you believe you have been charged in error, contact us and we will investigate.
8. Service availability
We aim to keep ClearMTD available at all times, but we do not guarantee uninterrupted service. The service depends on third-party systems including HMRC's API, which may experience downtime outside our control.
We may occasionally take the service offline for maintenance. Where possible, we will give advance notice.
9. Data and privacy
We take your privacy seriously. Our full Privacy Policy explains what data we collect, why, and how we protect it. By using ClearMTD, you agree to the terms of that policy.
10. Limitation of liability
To the fullest extent permitted by law:
- ClearMTD is provided "as is" without warranties of any kind, whether express or implied
- We are not liable for any penalties, fines, or charges imposed by HMRC as a result of incorrect data you submitted through ClearMTD
- We are not liable for any indirect, incidental, or consequential losses arising from your use of the service
- Our total liability to you for any claim related to the service is limited to the amount you have paid us in the 12 months before the claim
Nothing in these terms limits our liability for death, personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.
11. Intellectual property
All content, design, and code in ClearMTD is owned by SH Applications Limited. Your financial data remains yours — we claim no ownership of the data you enter.
12. Termination
We may suspend or terminate your account if you breach these terms, use the service fraudulently, or if we are required to do so by law. We will give you reasonable notice where possible.
On termination, your right to use ClearMTD ends. We will retain your tax records for 6 years as required by HMRC guidance, after which they will be deleted.
13. Changes to these terms
We may update these terms from time to time. If we make significant changes, we will notify you by email. Continued use of ClearMTD after changes take effect means you accept the updated terms.
14. Governing law
These terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
